These Terms govern your use of wednesday.now and the internal application at app.wednesday.now (together, the "Site"), which are operated by Wednesday Consulting, a Wyoming limited liability company ("Wednesday," "we"). By using the Site you agree to these Terms. If you don't agree, don't use the Site.
1. What the Site is
The public Site is informational. It describes Wednesday's advisory services and philosophy and provides a way to request a consultation ("Begin Here"). The internal application is a private tool used only by Wednesday personnel and invited collaborators.
2. No advisor–client relationship
Visiting the Site, reading the content, or submitting the Begin Here form does not create an advisor–client relationship between you and Wednesday. Nothing on the Site constitutes legal, financial, tax, accounting, or investment advice. Any advisory relationship is formed only by a separately executed engagement agreement signed by both parties.
3. Information is "as is"
The content on the Site reflects Wednesday's opinions and operating experience as of the date of publication. Every business is different. Relying on general content instead of on specific advice tailored to your situation is a bad idea. The Site and its content are provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
4. Limitation of liability
To the fullest extent permitted by law, Wednesday and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Site. Our aggregate liability to you for any claim related to the Site is limited to $100 or the amount you paid us in the twelve months preceding the claim, whichever is greater.
5. Intellectual property
The Site, its content (text, images, code, design, and structure), and the Wednesday name and marks are the property of Wednesday (or its licensors) and are protected by copyright, trademark, and other laws. You may view the Site and share links to it. You may not copy, reproduce, republish, frame, scrape, or distribute substantial portions of the content without our written permission.
6. Acceptable use
You agree not to:
- Use the Site to impersonate anyone, including Wednesday's personnel.
- Submit the Begin Here form with information you know to be false, or on behalf of someone who has not authorized it.
- Interfere with, probe, scan, or test the vulnerability of the Site or circumvent any security feature.
- Use automated systems (bots, scrapers, spiders) to access the Site beyond what
robots.txtallows. - Use the Site for any unlawful purpose or to transmit unlawful, harassing, or infringing content.
7. Third-party links and services
The Site may link to third-party sites or rely on third-party services (email, analytics, hosting). Those third parties have their own terms and privacy policies, which we do not control.
8. Modifications
We may update the Site and these Terms from time to time. Material changes will be posted with a new effective date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
9. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice — for example, if we suspect abuse or violation of these Terms.
10. Governing law; venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Exclusive venue for any dispute arising out of or related to these Terms or the Site lies in the state or federal courts located in Laramie County, Wyoming. You and Wednesday each waive any right to a jury trial.
11. Severability; entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wednesday regarding the Site.
